Terms of Service

Ordering and Custom Requests:

When placing your order, please choose a delivery date that’s at least two (2) business days out. If you have any specific instructions or requests, be sure to include them during checkout. A valid phone number is required to confirm delivery. Orders without one may be delayed or rescheduled. While we aim to deliver on your selected date, factors like road conditions, weather, or truck availability may cause occasional delays.

Order Confirmation and Delivery Planning:

You will receive an email confirmation detailing your order, payment, and delivery specifics upon successfully submitting your order. Please review this confirmation thoroughly to ensure all information is accurate. By placing the order, you agree to be available or have a designated contact
at the delivery site during the provided delivery window. 

Second Confirmation Email:

As the delivery date approaches, you’ll receive an email with details including the scheduled date, time window, and a photo of the materials being loaded onto the truck at their source. This photo is of the material that will be loaded onto the truck and delivered to you, though the coloring in the photo may slightly vary due to factors like sunlight, glare, or other conditions. By reviewing and approving this email, you agree to all aspects of the delivery, such as the timing, material type, color, final pricing and any additional specifics. By placing your order, you acknowledge that no refunds or cancellations will be allowed once you’ve accepted this confirmation email. Due to regional sourcing and supplier availability, final fulfillment details are confirmed after order placement. In the event any adjustments are required prior to scheduling, customers will be notified and may proceed or receive a full refund.

Delivery Site Requirements:

The customers are responsible for ensuring the delivery site is accessible to our trucks. A minimum road width of 12 feet is required to accommodate delivery vehicles. If access is restricted or unsafe, our team will attempt to deliver materials as close as possible to your requested site without compromising safety. A missed delivery fee may apply if the delivery cannot be completed due to access restrictions or site conditions.

Business Model & Alignment:

Gravel Monkey is a national aggregate broker, sourcing materials from a wide network of regional suppliers across the country. The product photos shown on our site are representative and provide a general visual reference for the type of material ordered. However, specific products, sizes, and colors may vary by region based on local quarry output and availability. While we aim to match the product as closely as possible to the photos and your preferences, exact matches cannot be guaranteed due to natural variation and geographic sourcing differences.

Delivery Scope and Scheduling:

Delivery availability and timing may vary depending on the destination and the type of materials ordered. While we strive to meet your chosen delivery window, product availability, traffic, and weather conditions may affect delivery times. If there are significant delays, we will notify you promptly to reschedule or confirm your delivery time.

Delivery Acceptance and Responsibility:

The customer must be present or have an authorized representative available to receive the delivery within the specified time frame. Upon unloading the materials, ownership and responsibility for the products pass to the customer. Once unloaded, the customer assumes full ownership and accountability for the materials. No refunds or exchanges will be provided under any circumstances after the materials have been unloaded, except as required by applicable law. We bear no responsibility for any damage to the materials or property following delivery.

Material Availability:

Gravel Monkey is a national broker with a network of thousands of partners nation wide. The product photos on our site are for general reference only and the exact product will be sourced from one of our local partners. Aggregate materials are natural products, and their color, shade and/or sizing may vary depending on local availability, seasonality, and regional geology. While we can’t guarantee an exact color match, we’ll make every effort to accommodate your preferences. If you have a specific shade or color in mind, please include that information when placing your order so we can try to source accordingly. Our standard cancellation policy will apply to cancellations due to color preferences. By placing an order, you acknowledge and accept these terms.

Missed Delivery and Re-Delivery Fees:

If delivery cannot be completed due to site inaccessibility or refusal to accept the material, we reserve the right to charge a missed delivery fee. In such cases, we will reschedule delivery as soon as possible, subject to additional re-delivery charges.

If the customer is not on site at the time of delivery, Gravel Monkey may, at its sole discretion, unload the material at the nearest accessible location. By not being present at the time of delivery, the customer acknowledges and accepts full responsibility for the material once it is dumped, including any handling or relocation that may be required.

Liability and Force Majeure:

We are committed to providing timely delivery services; however, we are not responsible for delays caused by events beyond our control, including but not limited to adverse weather, road closures, or equipment failures. In such instances, we reserve the right to reschedule delivery without liability.

Spreading & “Rolling Dump”:

All aggregate materials are sold as is. Gravel Monkey does not provide spreading or installation services, and such services are not included in the cost of materials.

In some cases, the delivery driver may offer a courtesy “rolling dump” (lowering the tailgate and slowly driving forward to distribute the material). However, this is entirely at the discretion of the driver at the time of delivery and cannot be guaranteed or requested in advance under any circumstances.

Additional Verification:

Gravel Monkey uses Stripe, one of the largest and most trusted payment processors globally, for credit card transactions. In some rare cases, additional verification may be needed to ensure the security of the payment. If necessary, we will notify you by email or phone to gather the required information and ensure a smooth processing of your order and the timely delivery of the aggregate.

Tax Treatment:

Customer acknowledges that transaction components administered by Gravel Monkey relate exclusively to service-based coordination functions. Any tax implications associated with material fulfillment, where applicable, are determined by the supplier’s role in furnishing such materials. Gravel Monkey’s charges reflect service-related facilitation and are not assessed as consideration for the sale of tangible personal property.

Relationship of Parties:

Customer acknowledges that Gravel Monkey functions as a coordinating entity within a multi-vendor fulfillment framework. In facilitating order requests, Gravel Monkey arranges procurement, scheduling, and delivery logistics through independent third-party material providers selected based on availability and geographic proximity. For operational purposes, all material fulfillment is executed by external suppliers, and any transfer of ownership in such materials, where applicable, occurs directly between the supplier and the Customer. Gravel Monkey’s role is limited to administrative facilitation and orchestration of the transaction process.

Service Structure and Fees:

Amounts charged by Gravel Monkey may include coordination, administrative, or facilitation components associated with arranging fulfillment. Such amounts do not constitute a standalone charge for tangible materials. Gravel Monkey does not represent itself as the originating source of supplied materials and does not assume responsibility for supplier-controlled aspects of the fulfillment process. Customer understands that materials are furnished by partner yards, pits and haulers, and any corresponding charges related to such fulfillment are incorporated solely for the purpose of transaction administration.

Supplier Independence:

Third-party suppliers operate independently and are not agents, employees, or subcontractors of Gravel Monkey. Customer authorizes Gravel Monkey to communicate its order specifications to such suppliers for the purpose of facilitating delivery. Gravel Monkey does not control supplier inventory, material characteristics, availability, or delivery execution; all such aspects remain solely within the purview of the supplying entity.
